Welcome to PlutoChat! These Terms of Service ("Terms") govern your use of our application ("App"), provided by PlutoChat ("we", "our", "us"). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Use of the App

PlutoChat provides an AI chatbot service that allows users to engage in conversations. By using the App, you agree to use it in compliance with applicable laws and these Terms. You must be at least 13 years old to use this App.

To use the App, you must sign in using Google OAuth. During this process, we collect your name, email address, and profile picture. This information is used for identification and to personalize your experience within the App. You agree to provide accurate and up-to-date information during registration.

3. User Conduct

  • Use the App for any illegal, harmful, or fraudulent purposes.
  • Interfere with or disrupt the App's services or servers.
  • Use the App to transmit harmful, abusive, or offensive content.
  • Use automated systems or scripts to access or scrape data from the App.

4. Chat Messages

Chat messages that you send through the App are stored for your convenience and to allow future review. You agree that we may store and retain your chat messages as part of your App usage.

5. Data Privacy

Your privacy is important to us. Please refer to our Privacy Policy to understand how we collect, use, and protect your personal information.

6. Payments

  • When you make a purchase or payment through the App, you will be directed to Stripe, a third-party payment processor, to complete the transaction.
  • Payments made through the App are non-refundable except as required by law.
  • You are responsible for providing accurate and up-to-date billing information when prompted by Stripe.

7. Third-Party Services

We may use third-party services, such as Vercel Analytics, to analyze user traffic and improve the App's functionality. These third parties have their own privacy policies, and we encourage you to review them.

8. Restrictions

We reserve the right to suspend or terminate your account if we determine that you have violated these Terms or engaged in any prohibited activity. We also reserve the right to modify or discontinue the App at any time.

9. Disclaimers and Limitation of Liability

The App is provided "as is" without warranty of any kind, either express or implied. We do not guarantee that the App will be error-free or available at all times. To the fullest extent permitted by law, we disclaim any liability for damages arising from your use of the App.

You agree to indemnify and hold harmless PlutoChat, its officers, employees, agents, and partners from any claims, losses, damages, liabilities, or expenses arising from your use of the App or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, specifically the laws of the state of Delaware. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Delaware, United States.

We may update or modify these Terms at any time. When we do, we will post the revised Terms on this page and update the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the updated Terms.
